I. CONDITIONS FOR VIETNAM WORK PERMIT EXTENSION – DECREE 70/2023/ND-CP

1. How many times can foreign workers apply for work permit extensions?

For group of manager position: can be extended once
For group of expert and technical worker position: can be extended twice

2. What are the requirements for work permit extensions?

To be eligible for work permit extensions, foreign workers must meet the following conditions:

The work permit issued is still valid for at least 5 days, but not more than 45 days, before the expiration date of the current work permit.
The employer has obtained approval from the competent authority for the demand to use foreign workers as prescribed. (Job position approval letter)
The foreign workers have documents proving that they continue to work for the employer, according to the content of the work permit issued.

II. DOCUMENT CHECKLIST FOR WORK PERMIT EXTENSION IN VIETNAM

Form for work permit application;
The approval document for the demand to use foreign workers – The job position approval letter;
An original valid work permit has been issued;
A notarized copy of the passport (full pages);
A notarized copy of the sponsored company's business registration certificate;
02 photos (size 4cm x 6cm, white background, face looking straight, no colored glasses), taken within 6 months from the date of submission;
A health check report issued by Vietnam-designated hospitals with a validity period of 12 months from the date of signing the health conclusion to the date of submitting the application.

III. PROCEDURES FOR EXTENSION OF VIETNAM WORK PERMIT

To extend your work permit, you must complete the following steps:

Step 1: Applying for the job position approval letter - Visa5s.com advises employers and foreign workers to prepare documentation for this step 45 days before the current work permit's expiration date.

Prepare a written request form that explains the demand to continue using foreign workers signed and stamped by your employer;
Submit this document to the Department of Labor, Invalids, and Social Affairs (DOLISA) via their official public service portal;
They will review your document and issue a job position approval letter within 10 days.

Step 2: Apply to extend your foreign work permit

The applicant prepares a set of documents listed in the work permit extension documents section.
Submit the required documents to DOLISA via their official public service portal at least 5 days, but not more than 45 days, before your work permit expires.
They will process your application and issue an extended work permit within 5-7 working days.

IV. WHAT NEXT TO DO AFTER HAVING WORK PERMIT EXTENSION

After completing the procedure and obtaining the work permit extension, the sponsoring company and the foreign worker have to submit an application for a temporary residence card or long-term labor visa so that the foreigner can reside in Vietnam for a long period of time.
