PROCEDURE FOR EXTENSION OF TEMPORARY RESIDENCE CARD VIETNAM

Living and working legally and long-term in Vietnam is always a topic that many foreigners are interested in. Therefore, Vietnam Temporary Residence Card (TRC) with a term from over 1 year to 10 years is always their top choice. However, after this temporary residence card expires, many foreigners are confused about how to extend this temporary residence card, and whether the process and procedures are complicated or not. ALL YOU NEED TO KNOW ABOUT VIETNAM TEMPORARY RESIDENCE CARD (TRC)

From March 2023 and as of the latest update by Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam, which is valid on August 15, 2023. Temporary Residence Card is issued for investors, shareholders, foreigners granted work permits and accompanying relatives of the granted resident card person. It is valid for 2 to 10 years, with a duration of at least one month less than the expiration of the passport and it is not issued to people whose passports are valid for less than one year.

In case foreigners have Temporary Residence Card but for some reasons such as the passport running out of pages and need to change the new one or losing of Temporary Residence Card to enter and exit Vietnam, they are required to change their Temporary Residence Card or apply for renewal according to the current card (in case of loss).


TYPE OF TEMPORARY RESIDENCE CARD IN VIETNAM (TRC) AND ITS VALITIDY

  1. The duration of a temporary residence card is shorter at least 30 days than the duration of the passport.
  2. The duration of NG3, LV1, LV2, ĐT or DH temporary residence card shall not exceed 05 years.
  3. The duration of NN1, NN2, TT temporary residence cards shall not exceed 03 years.
  4. The duration of a LĐ or PV1 temporary residence card shall not exceed 02 years.
  5. Expired temporary residence cards may be extended.
  6. The temporary residence card is only issued to foreign investors, and shareholders named on investment license or certificate business registration in Vietnam. It is also issued to expats who are salaried and work in any place in Vietnam.


WHO CAN APPLY FOR EXTENSION OF TEMPORARY RESIDENCE CARD VIETNAM

  1. Foreigners come to Vietnam to invest and their relatives (spouses, children under 18 years old)
  2. Foreign workers have been granted Work Permits in Vietnam and their relatives (spouses, children under 18 years old)
  3. Foreigners whose spouses are Vietnamese nationals
  4. Head of office, representative of non-governmental organization

 

REQUIRED DOCUMENTS APPLY FOR EXTENSION OF TEMPORARY RESIDENCE CARD VIETNAM

Temporary Residence Cards will not be issued if the applicant’s passport is valid for less than one year, and the duration of the residence card will always be at least one month shorter than the duration of the holder’s passport.

TRC'S REQUIRED DOCUMENTS BASING EACH CATEGORY

  1. Notarized copy of the Business Registration Certificate and Investment License which clearly and detailed shows the capital contribution of the foreign investor;
  2. Certificate of seal sample registration or Written notice of posting information about the enterprise's seal sample on the national business registration information portal.
  3. A valid and suitable Vietnam visa (type DT)
  1. A notarized true copy of work permit or work permit exemption;
  2. A valid and suitable Vietnam visa (type LĐ/DN)
  1. Consular legalized of Marriage Registration Certificate or Birth Certificate;
  2. A notarized true copy of the sponsor’s work permit or work permit exemption;
  3. A notarized true copy of the sponsor’s temporary residence card;
  4. A notarized true copy of the sponsor’s passport
  5. A valid and suitable Vietnam visa (type TT)

GENERAL DOCUMENTS

  1. Business License certificate/ Investment certificate/ Operating license/ Establishment decision (Depending on the type, there will be appropriate documents)
  2. A written request for a Temporary Residence Card (NA6 form) must be signed and sealed by a legal representative of the company;
  3. Declaration of foreign applicant’s information (NA8 form) must be signed by the applicant;
  4. Introduction letter;
  5. Two (2) passport-sized photographs (2cm x3cm);
  6. The applicant’s original passport;
  7. Proof of residence registration certified by local police station or online certification;
  8. If foreigners lose their Temporary Residence card: Application for loss of temporary residence card certified by the ward police committee.

NOTES FOR DOCUMENT PREPARATION

Kindly note that in case of accompanying relatives, documents showing proof of relationship such as birth certificates, marriage registration and family register must be consular legalized and translated into Vietnamese, unless they are exempt from consular legalization under the provisions of Article 9 of Decree No. 111/2011 / ND-CP dated 05/12/2011 of the Government on consular certification, consular legalization.

Step 1:

Preparing required documents for TRC extension.

Step 2:

Submitting your application directly at one of the three offices of the Immigration Department:

  • Immigration Department in Hanoi: 44 Tran Phu, Ba Dinh, Hanoi.
  • Immigration Department in Ho Chi Minh City: 333-335-337 Nguyen Trai, District 1, Ho Chi Minh City.
  • Immigration Department in Da Nang: 78 Le Loi Str, Da Nang City
  • Any the Immigration Department of the province/city police where the foreigner is registered for temporary residence

If your dossier is complete and valid, the Immigration Department will receive the dossier, give a receipt, and set a date to return the results.

Step 3:

Getting new Temporary Residence Card (TRC) - The processing time is 05 - 07 business days from the date of receiving complete documents
