VIETNAM WORK PERMIT IN HO CHI MINH CITY AND HA NOI – WHAT ARE THE STEPS AND HOW LONG DOES IT TAKE?

To apply for a new work permit for foreigners, whether in Hanoi or Ho Chi Minh City, you must complete the following three application steps. Currently, in both Ho Chi Minh City and Hanoi, the three-step approach as described in the table below is used for the following cases:

STEP 1:

Posting recruitment for expected positions

  • At least 15 days in advance from the expected date of the explanation report (Step 2), the company needs to post a recruitment advertisement to recruit Vietnamese personnel for the position expected to recruit foreign workers.
  • Note that companies need to create recruitment accounts on websites according to the provisions of Decree 70/2023/ND-CP.
  • During the 15 days of posting the job, the company needs to folow progress, and if a Vietnamese candidate is applying for the posted position, the company needs to review CVs and contact candidates to carry out the process. interview.

STEP 2:

Apply for job position approval letter 

(also known as a report explaining the need and changing demand for using foreign workers).

  • After the end of the recruitment posting period in step 1, if a suitable Vietnamese worker has not been found, then at least 30 days before the expected date of employing foreign workers, the company must process the step: applying for job position approval letter.
  • The explanation should mention:
  1. Working positions: managers, executives, experts, and technical workers
  2. Job Title: according to the actual needs of each company
  3. Estimated working time: not exceeding 2 years
  4. Working Form: Labor Contract or Internal Transfer.
  5. Job description and requirements for background knowledge and work experience; other requirements (if any).
  6. The reason for not recruiting Vietnamese workers for the position is being explained.

10 working days from the date of receipt of complete documents

STEP 3:

Apply for Vietnam Work Permit 

  • At least 15 working days in advance from the date the foreign worker is expected to start working, the company must apply for a work permit.

05 working days from the date of receipt of complete documents

(Under Decree 70/2023, amending and supplementing clause 2)

  • In the case of applying to extend the work permit, the company must apply at least 5 days in advance, but not more than 45 days before the date of expiration of the work permit.
