The confirmation content on Criminal  Record Number 2 shows more detailed content than Criminal  Record Number 1:

  • Criminal record status:
    + For people not convicted then write "no criminal record";
    + For those who have been sentenced, please write down the complete criminal record that has been expunged, the time of the expunged criminal record, unexpunged convictions, dates, months, and years of sentencing, the number of the judgment, the court that pronounced the sentence, the crime, applicable law provisions, main penalties, additional penalties, civil obligations in criminal judgments, court fees, and execution status.
    + In case people are sentenced to different sentences, information about that person's criminal record is recorded in chronological order.
  • Information on prohibitions from holding positions, establishing and managing businesses and cooperatives: Record detailed and complete information about bans from holding positions, establishing and managing businesses and cooperatives.

DETAILED CONTENT OF PROCEDURES AND STEPS TO APPLY FOR A JUDICIAL RECORD AT THE DEPARTMENT OF JUSTICE IN HO CHI MINH CITY & HANOI

Step 1:

Collect information you need to know

  • Passport/ID card/CCCD
  • Vietnam Visa or Temporary Residence Card, Permanent Residence Card
  • Latest Vietnam entry stamp (for foreigners)
  • Household registration book or Certificate of temporary residence in Vietnam with confirmation from the ward police where the applicant is living in Vietnam

Step 2:

Fill out the application for a criminal record certificate

If you have brought your passport, Vietnam/TRC visa, and registered temporary residence, the next step is to fill out the application form for a criminal record certificate. The declaration must be filled out accurately and in accordance with the documents you will submit to the Criminal Records Center. The necessary information in the declaration is:

  • Your personal information
  • Residential address in your country
  • Temporary address in Vietnam
  • Phone number and email
  • Full name – Your father's date of birth
  • Full name – Your mother's date of birth
  • Full name - Date of birth of your spouse (if any)
  • Your residential history since age 14 (including time period, address, job and place of work)
  • What type of criminal record do you want to request? – Number 1 or Number 2
  • The purpose of making a Vietnamese criminal record

Step 3:

Prepare documents

* For Vietnamese citizens

  • Declaration requesting issuance of a criminal record certificate;
  • ID card/CCCD/Passport of the applicant
  • Household registration book or temporary residence registration book or Permanent residence card (copy with original for comparison) or temporary residence confirmation from the competent authority of the place of residence.
  • Authorization letter to submit and receive criminal record results (In case the authorized person is the father, mother, wife, husband, or child of the authorizing person, an authorization document is not required); (Does not apply to judicial record certificate Number 2)
  • ID card/CCCD/Passport of the authorized person.(Does not apply to judicial record certificate Number 2)

* For foreigners:

  • Declaration requesting issuance of a criminal record certificate;
  • Applicant's passport
  • Applicant's valid Vietnam Visa or Temporary Residence Card
  • Latest Vietnam entry stamp (for foreigners)
  • Household registration book, Certificate of temporary residence in Vietnam certified by the local police where the applicant is living (For applicants currently residing in Vietnam);

Step 4:

Submit Vietnam Criminal Record application and pay fees

  • Form of submission: Present and submit directly to the Department of Justice, send by post or authorize another person to carry out the procedure (only for applications for judicial record Number 1)
  • Presenting requirements: Require the applicant to present in person, send mail or authorize someone else to carry out the procedures (only for applications for judicial record Number 1)
  • Fee payment: After submitting the application, the applicant pays the certificate issuance fee directly or by bank transfer.

Step 5:

Wait and monitor the approval status

  • After submitting the application, the applicant or the authorized person will know the processing date and results received date through an appointment letter or email from the center.
  • During the review period of 15-20 working days from the date of application submission, if the prepared application is incomplete or incorrect, the center will contact via phone number or email to request additional documents.

Step 6:

Get results

  • How to receive results: The applicant comes to receive the results in person and authorizes them to receive the results (Applies to judicial record Number 1) or by post (Results will be received 1-2 days later than the appointment letter or longer depending on the delivery area)

Step 1:

  • Valid notarized/authenticated copy of the applicant's Passport
  • Notarized/valid certified copy of Vietnam Visa/ TRC (If still valid);
  • Authorization letter to submit and receive consular authentication results (Does not apply to Judicial Record Certificate Number 2)
  • ID card/CCCD/Passport of the authorized person (Does not apply to Judicial Record Certificate Number 2)
  • Registration form to receive results by post (If you want to receive results via email)

Step 4:

Submit application

and pay fees

  • Form of submission: Authorization to submit documents directly (only for applications for Judicial Record Number 1) or the applicant sends it directly by post (if applicant is abroad)

Reasons for refusing to issue a criminal record certificate: The agency competent to manage the Judicial Record Database has the right to refuse to issue a Vietnamese Judicial Record if the applicant falls into one of the cases below. In case the Vietnamese authorities refuse to issue a criminal record, they must notify and explain.

 

  1. Expiry date of criminal record certificate
    Currently, Vietnam's judicial record law does not specifically stipulate how long a judicial record is valid for use. But this will depend on the requirements of the agency asking you to provide your Vietnamese criminal record.
    For example: For work permit application procedures, the Vietnamese criminal record certificate is valid for 6 months from the date of issue.
