DEFINITION OF FOREIGN MANAGEMENT, EXPERT, TECHNICAL LABOR DUE TO DECREE 219/2025/ND-CP
βΊ Definition of Management
According to Clause 24, Article 4 of the Law on Enterprises, management positions include:
πΉ Owner of a private enterprise
πΉ General partner
πΉ Chairman or member of the Board of Members
πΉ Company President
πΉ Chairman or member of the Board of Directors
πΉ Director or General Director
πΉ Other managerial positions as specified in the company’s charter
β¨ A management position can also be the head or deputy head of an agency, organization, or enterprise.
βΊ Definition of Experts: According to Clause 3 Article 3 of Decree 219/2025/ND-CP, Experts are defined as follows:
π’ Hold a university degree or higher (or equivalent) and at least 2 years of relevant work experience in Vietnam;
π’ Hold a university degree or higher in the relevant field + at least 1 year of work experience, applicable to experts working in:
πΌ Finance
π¬ Science & Technology
π‘ Innovation
π National Digital Transformation
π Other priority socio-economic development areas (as determined by ministries, provincial People’s Committees, or under cooperation agreements of the Vietnamese Government)
βΊ Definition of Technical laborers: According to Clause 4 Article 3 of Decree 219/2025/ND-CP, Technical laborers are defined as follows:
πΈ Completed at least 1 year of training + at least 2 years of relevant work experience.
πΈ Possess at least 3 years of relevant work experience for the intended position in Vietnam.
PROCEDURE ON GETTING WORK PERMIT NEW ISSUANCE FOR FOREIGN LABOR WORKERS FROM 07 AUGUST 2025
According to Decree 219/2025/ND-CP, to apply for a Work Permit (both new issuance and extension), foreign employees and their sponsoring companies only need to go through 2 steps, without having to undergo the 3-step procedure as required under Decree 70/2023/ND-CP previously.

Step 1: Applying for Job Posting πΉ From Jan 1, 2024 onward, job vacancy announcements must be posted on the website of the Employment Department (under DOHA) or the Employment Service Center. |

THINGS TO NOTE WHEN PREPARING THE DOCUMENT FOR WORK PERMIT APPLICATION
π All documents issued by foreign authorities (e.g., diplomas, certificates, experience confirmation, appointment letters, health certificates, criminal records, etc.) must be consular legalized and then translated into Vietnamese and certified.
π For foreign employees applying under the Internal Transfer category (intra-company transfer), additional documents are required:

An Appointment Letter from the overseas parent company assigning the employee to the Vietnam subsidiary.

An Employment Certificate proving that the employee has worked for the overseas parent company for at least 12 consecutive months immidiately before transferring to Vietnam.
DURATION OF VIETNAM WORK PERMIT
π The initial validity of a Vietnam Work Permit is up to 2 years.
π It can be extended once for an additional 2 years (applies to all employment types).
π After the extension period expires, if the foreign employee continues working in the same job position for the same employer, they must apply for a new Work Permit.
